Terms & Conditions

The Application & Agreement, Policies & Procedures and Supporter Rebate Program are specifically incorporated herein by reference. They, along with these Terms & Conditions, form the Agreement between:

The Supporter AGREES:

1. The Supporter is of legal age in the state or country in which he/she resides.
2. This position does not constitute the sale of a franchise and no fee, charge or required purchase for participation as a Supporter has been required of me for participation as a Supporter.
3. Any Supporter who introduces another Supporter or receives a Rebate on the product purchase of another Supporter must fulfill the obligation of performing a bona fide supervisory function and in the assisting of training of those introduced, realizing that Rebates are only received when purchases of products for fundraising purposes are made. Supporters must have ongoing contact, communication and arrangement with his or her organization of Supporters. Examples may include, but not limited to: email, newsletters, correspondence, meetings, telephone contact, accompanying individuals to whhf orientation sessions and sharing genealogy information with those introduced. Supporters should be able to provide evidence to the whhf, if requested, of such ongoing fulfillment of these responsibilities.
4. The Supporter understands that he/she is not compensated for introducing other Supporters but receives Rebates solely on purchases of products and/or services for fundraising purposes.
5. The Applicant is, upon acceptance, an "Independent Contractor", called a Supporter, conducting activities for her/his own account and not as an agent, employee, or franchisee for the whhf. As such, the Supporter must provide his/her Social Security or Federal Tax ID Number when applicable. All Supporters should consult their attorney or tax consultant for information on monies earned and where received. The Supporter further understands that he/she will not be treated as an employee in regard to any laws covering employees. An Independent Contractor shall be responsible for obtaining any licenses required by law in whatever State, County or Country in which they reside, and pay all applicable fees and taxes.
6. The Supporter agrees to accept sole responsibility for all self-employment and all legal country/federal and state and local income and sales taxes and any other taxes on income earned. The whhf will keep proper, confidential records on each Supporter.
7. The Supporter agrees that the whhf will not be liable whatsoever for city, county, state, local and country/federal taxes or other fees pertaining to efforts and earnings of a Supporter and the Supporter will hold the whhf harmless from all of same.
8. The Supporter SHALL NOT promote or sell other organizations’ products or functions, or on websites where the whhf is mentioned or use the whhf forms or printed materials or its name and prestige, or drawing power in conjunction with or in support of any other activities.
9. The Supporter shall not introduce or attempt to introduce another whhf Supporter into any other similar program except for his/her personally introduced Supporters. In addition, no Supporter shall participate in any action that causes another Supporter to be introduced through someone else into another program.
10. The Supporter will make no claims as to income potential either written or oral except those prepared by the whhf for illustration purposes only.
11. The Supporter will not make any claims of any kind pertaining to benefits of the whhf’s products and services to be sold for fundraising purposes except those given in official whhf promotional media. When presenting the whhf program to others, Supporters shall present the program in its entirety, without omission, distortion or misrepresentation.
12. The Supporter shall not represent or imply, directly or indirectly, that the whhf has been approved or endorsed by any governmental agency. Federal and State regulatory agencies do not approve or endorse any programs.
13. The Supporter will indemnify and hold the whhf harmless from any and all claims, expenses, costs, causes of action and damages resulting from or growing out of the Supporters statements or actions in violation of this agreement.
14. Should the Supporter be terminated for cause, the Supporters organization shall be transferred to his/her first active upline Supporter.
15. I will not purchase products for fundraising purposes solely for qualification of Rebates.
16. All product(s) in resalable condition purchased within 90 days prior to termination may be returned (shipping prepaid). The whhf will repurchase such products at 90% of original price less any Rebates paid. Any laws in any jurisdiction inconsistent herewith are adopted herein and will be followed.
17. The terminated Supporter will be eligible to reapply and may choose a new introducing Supporter after six (6) months. A terminated Supporter that reenters the program may not introduce any of her/his original organization.
18. The Supporter understands that the whhf does not permit changing of introducing Supporters. The whhf encourages the creation of relationships. Once a Supporter is introduced, the whhf believes in maximum protection of that relationship.
19. The Supporter understands that he/she receives Rebates monthly when applicable.
20. The Supporter understands that the whhf will provide the Supporter a replicated Web Page, when available as part of the whhf’s commitment to the success of the Supporter.
21. As an Independent Contractor, the Supporter is aware of the quality of products offered by the whhf for fund raising purposes and other costs and contractual obligations that occur when he/she purchases products from the whhf. The Supporter understands that he/she maintains a greater responsibility when ordering on a credit card account as an informed Supporter. The Supporter therefore waives the right of cancellation or refund on any order placed on his/her credit card account(s) except through the whhf. Any order returns, refunds or exchanges shall be done through the whhf and not through any credit card organization.
22. In the event that any monies by any method is returned unpaid, I authorize the whhf to debit my account for the face amount plus up to a $75 processing fee. If said amount remains unpaid, I understand that I could lose my current status and that until my account is brought current I could forfeit certain rights and privileges, including Rebates.

THE WORLD HEALTH & HUMANITARIAN FOUNDATION AGREES:

1. To pay Rebates to the Supporter on purchases of products and/or services for fundraising purposes by Supporters in his/her organization under the terms of the Supporter Rebate Program.
2. To retain full authority to accept or reject any Application or any order for products. Such refusal is solely within the discretion of the whhf. No right of action against the whhf will arise because of any such acceptance or refusal.
3. The whhf reserves the right to amend, revise, institute, alter or modify changes including but not limited to prices, literature, policies, this Agreement, Policies and Procedures, and the Supporter Rebate Program. Any such revisions become effective and binding upon submission, posting and updating to the whhf website. The Supporter agrees to be bound by these changes.
4. The whhf provides the following fulfillment to its Supporters: A replicating website; shipment of ordered products for fundraising purposes within ten (10) days of receipt of order and cleared funds, subject to availability of items ordered; calculation and payment of Rebates to Supporters when applicable. The whhf may in the future require an annual renewal fee.
5. The whhf shall not be responsible for acts beyond its control, including but, not limited to: fire, flood, earthquake, storms, power outages, labor difficulty, equipment failure, supplier problems, or other difficulties that might prevent performance according to this agreement.
6. The whhf assumes no liability for personal injury arising from use or mishandling of any of the whhf fundraising product(s).
7. The whhf does not require the Supporter to introduce other Supporters and does not require any fee, charge or product purchase to be a Supporter.
8. The whhf reserves the right to terminate this agreement immediately upon receipt of sufficient information that the Supporter has violated any term or condition of this agreement or has otherwise acted illegally or unethically.
9. The whhf will honor refund policies provided by any governmental law applicable to the Supporter.
10. The whhf requests that all Supporters obey the letter and the spirit of the law.
